CIBT accepts instructions only upon the terms and conditions set out below. No servant or agent of CIBT is permitted to vary these terms and conditions unless expressly authorised in writing to do so. However any servant or agent shall have the full benefit of these terms and conditions.
These terms and conditions govern the provision of all and any services provided by CIBT in respect of but not limited to the processing of visas, passports and/or documents for their clients and all orders placed by their clients are made and accepted subject to the terms hereinafter set out. By sending applications to CIBT for processing, you accept all of the requirements, restrictions and limitations on liability set forth herein and specifically agree and confirm that neither CIBT nor your travel company shall be liable to you for any failure to comply with the necessary visa requirements for your travel, for the action or inaction of any government body and/or for the performance by any third party delivery company. In no event shall CIBT be liable to you for any indirect, special, consequential or incidental losses or damages, including, without limitation, lost profits, or for exemplary damages, and that your sole and exclusive remedy against CIBT for damages in connection with the failure to obtain a requested visa or visas in a timely manner shall be the return of the CIBT service fees actually paid by you or £250, whichever is less. At all times and under all circumstances, CIBT's total liability to you for any and all claims, causes of action, liabilities and damages of any kind shall not, in any circumstance or for any reason, exceed the lesser of the fees actually paid by you to CIBT or £250. Any claims filed to CIBT must be filed within 60 calendar days from the date of invoice.
CIBT will use its best endeavours to process applications for visas, passports and/or documents at the client's request. However, CIBT shall not be held responsible for nor accept any liability for the actions of any consulate, embassy, or passport office in delaying or not issuing such applications for any reason whatsoever, nor shall CIBT be held responsible for expense and/or delay arising from or in connection with: (a) incomplete application forms or (b) incorrectly or falsely completed application forms or (c) inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility of, nor shall any charges be levied upon, CIBT. Tickets for travel should not be purchased prior to the visa/passport being issued unless they are a specific requirement for that consulate and in such cases open tickets should be obtained.
Where an Australian Electronic Visa (ETA) OR US ESTA has been requested, the fee paid to CIBT includes processing of the ETA/ESTA visa only and does not include any appeals or additional services. The cost of the ETA/ESTA application is non-refundable and should your application be refused, or an existing ETA/US ESTA (duplicate record) is found for the traveller(s), you will not be issued a refund. In such circumstances, we will issue you with confirmation of your current ETA status. Errors in your application cannot be edited, in the event that you notice an error you will need to reapply.
In the event an ETA/ESTA is referred CIBT will attempt to assist the traveller in procuring the relevant documents to meet the client’s desired travel plans however in any event, travel plans should not be confirmed until the traveller has secured the necessary documents to allow entry.
The absence of a CIBT order form constitutes acceptance of CIBT’s Passport Replacement Service. Charges will apply.
CIBT provides carefully compiled visa and passport information in good faith on the express understanding that the said information is the interpretation of any or all information provided by respective embassies, consulates or passport offices at any or all times and CIBT shall not accept responsibility or liability whatsoever for any errors and/or omissions in the information.
CIBT will endeavour, wherever possible, to process the client's visa, passport and/or document based on the instructions given and application forms submitted, although it is the client's express responsibility to ensure that the validity of the said visa/passport/document obtained includes and covers the periods of time in which the client plans to enter and leave the country or countries that the client is visiting and for the number of entries to that country and is valid for the purpose intended.
Should a passport, document or other item be lost, misplaced, damaged, delayed or destroyed by any means whatsoever, CIBT shall only be responsible for the basic replacement cost of said item should the fault rest with them. CIBT is not responsible for items misplaced, damaged, delayed or destroyed by a consulate, embassy or passport office. Passport covers and all documents such as original bank statements, educational and birth certificates etc not requested for submission per CIBT instruction should be retained by the applicant. CIBT accepts no responsibility for the loss or damage of such documents.
The fee which shall be payable by the client in respect of services provided by CIBT is exclusive of any consular or embassy charges whatsoever. Such consular or embassy charges as may be made will be the absolute liability of the client who must make payment in respect of those charges. CIBT reserves the right to raise its charges at any time with or without prior notice.
Consular fees and availability of services are subject to change without notice. Fees and services may differ between the time the order is placed and when the ordered is completed. CIBT will endeavour to communicate said changes to the client where possible. CIBT reserves the right to select the most appropriate service available given the time constraints as indicated by the client.
CIBT will send completed applications by Secure Mail unless otherwise instructed. A delivery charge will be added to your order. Secure Mail, Same day couriers, UK Overnight Couriers, International Courier services and other third party delivery companies are subject to the conditions set by these individual companies. CIBT accepts no liability for loss or delays incurred when using third party delivery companies.
Payment of CIBT fee is due together with any anticipated consular or embassy charges upon CIBT being instructed unless account facilities have been agreed in writing prior to the said instructions.
Unless instructions are made in writing CIBT shall not be held responsible for taking such steps as are reasonably considered as fulfilling the implied instructions of the client and/or as being in the best interest of the client and any charges for such services rendered shall be wholly the responsibility of the client.
Where CIBT receives any personal data, as defined by the Data Protection Act 1998, from the client it shall ensure it fully complies with the provisions of the Act and only deals with the data to fulfill its obligations under the contract. CIBT shall indemnify the client for any breach of the Act which renders the latter liable for any costs, claims or expenses. CIBT shall allow its staff reasonable access to the information as is necessary to ensure completion of the contract.
CIBT reserves the right to retain all passports and documents until payment of the aforementioned amounts is received in full.
The data available on this website is solely for the use of CIBT customers. CIBT reserves the right to block website access and/or take legal action against any users who it may deem to be accessing the website for illegal or unauthorised use.
CIBT reserves the right to refuse in its total discretion to handle any application or carry any item at any time and no reason need be given.
These terms and condition shall be governed by and construed in accordance with the laws of England.
